As the spate of class actions between various mobile phone companies continues to increase, Motorola have become the latest to file an action, this time against Research in Motion (RIM), the owners of Blackberry. Making the filing against the Canadian company, Motorola claim that the firm has been making use of wireless related technology illegally and have asked regulators in the US to ban Blackberry products from being imported.
It is not the first time that Motorola have highlighted this infringement upon their property rights, and currently the case is already due to go through the US court system. However, as Motorola accused RIM of using “delaying tactics”, they took their complaint to the US International Trade Commission (ITC) hoping that a result could be achieved more quickly. Jonathon Meyer, Legal representative for Motorola explained “Motorola has no choice but to file a complaint with the ITC to halt RIM’s continued infringement.”
Whilst ongoing court case can take years to complete, the ITC average approximately one month from when a complaint is filed to decide if an investigation needs to be launched. The full process normally takes 12 to 14 months to complete and though they cannot award damages, they can halt the importation of goods into the US.
As RIM refused to comment on the situation, Motorola expressed in a statement that “These patented technologies are important to Motorola as they allow for more comprehensive connectivity, a better user experience and lower product costs.”

They’re just moaning because Motorola is a forgotten relic in current cell phone sales. They’d rather dump millions into phone like the Aura instead of trying to innovate and stay competitive. People love Blackberry products, because they are higly functional at a reasonable price. (Reasonable for the amount of features. remember when cell phones were$2000?) Unlike Motorola which makes antiquated featureless phones that best function is that of a paperweight.
